Accidents are part of life, unfortunately, and they frequently injure you or loved ones. Common types of accidents are automobile accidents, boating accidents, dog bites, construction defects and slip and fall accidents (to name a few). When you are injured in an accident as a result of someone else’s negligence or intentional acts, the law may provide you compensation to cover expenses incurred and the pain endured as a result of such accident.

If you are injured, physically or financially, by someone else’s conduct, whether intentionally or negligently, you may pursue compensation. Negligence is generally defined under the law as doing or failing to do something that a reasonable person would do in similar circumstances, where such act or failure to act causes injury. The basic principle under the law is that if a person injures you, they must pay the sums needed to restore you to the position you were in before the accident.

    In many accidents, such as automobile accidents, bodily injury is not the only type of damage suffered. Where property is damaged as a direct result of another’s negligent actions, you may be entitled to recover the value of the property lost or the cost to repair the item that was damaged.
  • Loss of the Pleasures of Life Damages
    This is a type of damage that encompasses and compensates for activities that a person can no longer do as a result of injuries sustained in an accident. This may be the inability to play with children, perform or engage in a sport, have intimate relations with a spouse, etc.
  • Pain and Suffering
    Injuries rarely occur without pain, and the pain associated with an accident may be compensated, separately and in addition to other damages listed here. The value that is placed on pain and suffering damages is different from case to case; however, the more serious and painful the injury, the greater the pain and suffering damages that may be awarded.
